It is important, if you have a choice of countries in which you could potentially issue divorce proceedings, to select the jurisdiction most favourable to your circumstances. Speed is often crucial in this situation as, in the EU, the first country in which an application is made will retain the right to hear your case, even if you would benefit financially from it being heard elsewhere. It is therefore important that you take legal advice without delay if this may apply to you.
Our
Family Law brochure gives more information on these fundamental issues and outlines Dawsons' experience in this area of family law. Additionally, our
Capital and Prenups International Table 2007 and
Spousal Maintenance International Table 2007 provide some guidance as to the varying legal position in other jurisdictions.
